TERMS OF USE

All graphics images, actions, photoshop brushes and other Content contained herein are copyrighted by Kim Hill / Photos by Kim Hill with all rights reserved. By purchasing a downloadable product or free samples you are obtaining a "license to use" this Content from Kim Hill / Photos by Kim Hill and you are agreeing to the terms of this user license.

All graphics images, actions, photoshop brushes and other Content are copyrighted property and are licensed to you, not sold to you. They do not become your property; you are obtaining a license to use them. Only you are permitted to use the Content. Any additional persons who wish to use the Content must download it from the Photos by Kim Hill themselves.

This license agreement applies to all materials created by or authored by Kim Hill / Photos by Kim Hill including, but not limited to, brushes, textures, actions, overlays, templates, graphics, elements, images, kits, avatars, layouts, fonts, free samples, CDs, DVDs, videos, visual interfaces and text ("Content"). Content may not be used for commercial purposes without express written permission from the owner, Kim Hill (kim@photosbykimhill.com), except as outlined below.

PERMITTED USES:

You may:

(a) use and incorporate the Content in flattened JPG format for creation of photographs, photo albums, coffee table books, and greeting cards for your photography business clients;

(b) alter Content by changing the size, color, adding to or deleting from said Content.

(c) use portions of this product in your photos that are submitted to photography and/or related magazines and web sites for publication as long as proper credit is given to Kim Hill and a link is provided to http://www.resources4photographers.com.

(d) print a hardcopy of Content to be used in your business marketing projects.

(e) make one (1) copy of the Content solely for back-up purposes; you must reproduce all proprietary notices on this single back-up copy;

(f) use the Content to alter your own flattened photographs, photo albums, coffee table books, and greeting cards for resale;

(g) use as much of the Content as you deem necessary in one of your projects;

(h) modify the Content in any way to fit your needs in creating said photographs, photo albums, coffee table books, and greeting cards as long as the Content is not taken as is and claimed as one's own.

PROHIBITED USES:

You may not do anything with the Content that is not expressly permitted. You may not provide a copy of the Content, or any portions thereof, to anyone or allow anyone to gain access to the Content, or any portion thereof, except as permitted above. For greater certainty, you may not:

(a) use the Content to create professional or commercial use products for resale to other designers, photographers, or for Scrap-for-Other creators;

(b) use the Content in design template applications for resale, including, without limitation, website templates, flash templates, and brochure design templates for sale; however, personal or business use on your own blog is fine;

(c) display the Content on websites designed to induce sales of "print on demand" products, including postcards, mugs, t-shirts, posters and other items (this includes custom designed websites as well as sites such as http://www.cafepress.com); however, please contact me as this is an option with a separate paid license fee and signed license agreement;

(d) claim Content or altered Content as your own. You may not alter the Content and call it your own. You may not take apart any of the Content and add it to your own Content and claim the resulting Content as your own.

(e) use the Content or any part thereof as part of a trade-mark, design-mark, trade-name, business name, service mark, or logo;

(f) use the Content in a fashion that is considered by Kim Hill/Photos by Kim Hill (acting reasonably) as pornographic, obscene, defamatory or libelous in nature;

(g) remove any notice of copyright, trade-mark or other proprietary right from any place where it appears on or in the Content or its accompanying materials;

(h) sub-license, re-sell, rent, lend, or otherwise redistribute the Content;

(i) post a copy of the Content on a network server or web server for use by other users; or

(j) transfer the rights to the Content or accompanying materials (if applicable), except as specifically provided for elsewhere in this Agreement.

(k) offer the original Content on any webpage for download, send the Content through a list such as a news or Yahoo group or include them in any other collection either on the internet or otherwise.

(l) link to our server - meaning you may not make the graphics show up on your website by pulling them off http://www.resources4photographers.com.
